(Atraso e complicação do negócio)

Belgium scrambles to assess Fortis court decision

BRUSSELS, Dec 13 (Reuters) - Belgian financial experts gathered on Saturday to assess a crushing court decision to suspend the state-led carve-up of Fortis NV, with ministers possibly set to meet later in the day.

The appeal court in Brussels ruled late on Friday that shareholders must be given a say in the dismantling of the troubled financial group, throwing doubt on major deals to rescue the company.

Fortis (Amsterdam: FORAL.AS - news) was divided up by the Dutch, Belgian and Luxembourg governments in October, with BNP Paribas SA (Paris: FR0000131104 - news) buying the Belgian operations after an 11.2 billion euro ($14.86 billion) cash injection failed to calm investors.

The decisions of the Fortis board on October 3, 5 and 6 have been frozen after the appeal court ruled that Fortis put them to shareholders at a meeting on Feb. 12.

'An atom bomb under the sale of Fortis,' was the headline on Belgian newspaper De Standaard. Belgian media unanimously declared the court's sudden ruling a surprise.

Financial experts from the government and the central bank met to review the decision. Core (Berlin: LJ1.BE - news) members of the cabinet may meet later on Saturday.

The government declined to give any further comment.

According to the court decision, the Belgian state would be forbidden to sell Fortis assets to BNP Paribas before Feb., 16, 2009 and would face a 5 billion euro penalty if it did.

BNP would be obliged to maintain its interbank support for Fortis Bank, the arm in which it was to buy a majority stake.

Parties could seek to bring the case to Belgium's Supreme Court, but only if they identified procedural problems.

Senior Belgian officials have argued that Fortis faced collapse if the transactions had not been struck.

BNP Paribas said on Friday it was still planning to close its deal to buy a majority stake in Fortis soon.

'This decision in no way calls into question the interest of this deal,' the French bank said in a statement.

Shares in Fortis have fallen to less than 1 euro from almost 30 euros in April 2007 when it launched its ill-fated joint bid for Dutch rival ABN AMRO (Amsterdam: AABA.AS - news) , prompting the legal action.

Shareholders rejected a proposed chairman at rowdy meetings earlier this month as they voiced their anger at executives they hold responsible for their losses. They also argue they were short-changed by the state-led carve-up.

Fortis shares were suspended on Friday afternoon in anticipation of the ruling.

BNP Paribas exposure to funds managed by Madoff Investment Services

Paris, 14th Dec. 2008

While BNP Paribas has no investment of its own in the hedge funds managed by Bernard Madoff Investment Services, it does have risk exposure to these funds through its trading business and collateralized lending to funds of hedge funds.

If, as a result of the alleged fraud, the value of the assets of these hedge funds is nil, BNP Paribas' loss could amount to around 350 million euros.

Due to recent extremely unfavourable market conditions the bank's CIB division is loss making over the first 11 months of 2008.
The Group is largely profitable over the same period

Paris, 16th Dec. 2008

Given the market dislocation and the extreme volatility, aggravated by Lehman's bankruptcy and its violent market repercussions, which have continued since the end of September, BNP Paribas' Corporate and Investment Banking (CIB) division has realised negative revenues in November, as it did in October.

Given the high cost of risk, CIB's pre-tax profit for the first 11 months of the year registered a €710 million loss (including the €350 million impact of the Madoff affair).

Due to the enduringly difficult environment, BNP Paribas' CIB division will implement a package of measures :

- Reduce both market risk and bonds inventories
- Evolve products to meet clients' new requirements (development of flow products and simpler derivative products)
- Adapt the platforms and the means allocated notably to the fixed income credit business and to the most complex products
- Consider measures which could lead to a reduction of worldwide staffing levels in CIB of around 5%.

BNP Paribas is one of the leading CIB players which has resisted best to this unprecedented financial crisis. With this strategy of facing up to the crisis and making the necessary adjustments, CIB will continue to focus on its client franchises, within its markets and financing businesses, and will remain among the industry's best performers.

Thanks to the Group's diverse activities and the dominance of retail banking in its business mix, BNP Paribas, naturally, is largely profitable over the first 11 months of the year.

A) Relativamente à incerteza toda à volta do negócio Fortis:

O porta-voz do BNP Paribas recusou comentar a notícia.

(R): 35€

(S): 31,2€<>30,0€

Boa noite,

Alguem poderia comentar o gráfico se faz favor?
